End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you and GitchatSH (the "Licensor") governing your use of the Gitchat software (the "Software"), including the iOS application, desktop/IDE extensions, web interface, and any related services (collectively, the "App").

1. License Grant

Licensor grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on devices that you own or control, solely for your personal or internal business use, subject to the terms of this EULA and the Apple Media Services Terms of Service (where applicable).

The Software is licensed, not sold. Licensor and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. Your rights are limited to those expressly granted in this EULA.

4. Third-Party Services

The Software integrates with third-party services including GitHub, Apple Sign in, and others. Your use of those services is governed by their own terms and privacy policies. Licensor is not responsible for the availability, content, or practices of third-party services.

5. Updates

Licensor may, at its discretion, make updates, patches, and new versions of the Software available. This EULA governs any such updates unless accompanied by a separate license.

6. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and delete any copies.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SOFTWARE.

9. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations of the U.S. Department of Commerce.

10. Governing Law

This EULA is governed by the laws of the jurisdiction in which the Licensor is established, without regard to conflict-of-law principles.
